## Quick answer

Liability is legal responsibility for harm. In a car accident claim, the driver who is liable, usually through their insurer, pays the injured person's damages.

## In a car accident claim

Deciding liability is often the first dispute in a claim. Insurers look at the police report, photos, video, witness statements and which traffic laws were broken. Most claims rest on negligence: a driver who failed to use reasonable care is liable for the harm it caused.

More than one person or company can share liability. An employer can be liable for an employee's driving, a vehicle owner or a bar that over-served a drunk driver may share responsibility in some states, and a government body may be liable under special rules. When you were partly at fault too, your state's fault rule decides how your own share counts; the [fault-rule explainer](https://accidentclaimfacts.com/tools/fault-rule-explainer/) shows each rule. The at-fault driver's liability insurance pays only up to its policy limits. ## Example

> **Example:** A driver going straight through an intersection is hit by a car turning left. The turning driver's insurer accepts liability but argues the other driver was speeding and shares 20% of the blame. In a comparative fault state, the injured driver's recovery would be reduced by that 20%.

## FAQ

### What does it mean when an insurer accepts liability?

It means the insurer agrees its driver was responsible for the crash, at least in part. It does not mean the insurer agrees with the amount you ask for; damages are negotiated separately.

### Is liability the same as fault?

They are closely linked. Fault describes who was careless; liability is the legal responsibility to pay that follows. Someone can be liable without driving, such as an employer for an employee's driving on the job.
